1. Definitions

  • Contact us: this is the section of the Site specifically dedicated to Users who want to ask to be contacted or want to send a request for information.

Profiling is aimed at ensuring that Users can receive Newsletters with information selected according to their tastes and preferences.

  • Treatment: any operation or set of operations concerning Personal Data, such as, by way of example, the collection, organization, structuring, storage, modification, extraction, consultation, use, communication , interconnection, limitation, cancellation and destruction. Users: all users of the Site.

2. Data Controller

The Data Controller referred to in this Notice is AUDAS sro, with registered office in Na Folimance 2155/15, Vinohrady, 120 00 Praha 2, Company Number 173 00 924 (“AUDAS”).

Each User can send AUDAS any request relating to the Processing concerning their Personal Data (including the exercise of the rights referred to in point 7 below) by registered letter with return receipt to the registered office, or by email to the following address:

3. Purpose and legal basis of the processing

AUDAS collects and uses the Personal Data of Users for the achievement of the following purposes:

  • Allow browsing on the Site, essentially through the use of Cookies.

    The collection of Personal Data for the purposes referred to in letter a) is governed by the information relating to Cookies in the dedicated section which AUDAS recommends reading.

  • Allow Users to send a request for contact, or information, to AUDAS.

    The processing referred to in this letter b) is necessary to allow Users to send AUDAS a request for contact, or information, through the Contact Us section on the Site.

    This processing is based on the free, specific, informed and unequivocal consent that the User expresses through positive action on the Site (ie filling in the fields specifically dedicated to the request and present in the Contact Us section, as well as sending the request to AUDAS by clicking on the send inquiry).

    The refusal of the User to the Treatment referred to in this letter b) precludes the User from sending the request for contact, or for information, and from being subsequently contacted by AUDAS.

    The User has the possibility to revoke the consent at any time by following the instructions in point 7 of this Notice, it being understood that the revocation of the consent does not affect the processing carried out before the revocation itself.

  • Allow Users to receive Newsletters.

    The collection of Personal Data for this purpose is aimed at allowing Users to receive newsletters periodically with commercial and informative content of the services and events organized or promoted by AUDAS.

    The processing of users' personal data for newsletters can also take place through profiling, in order to identify the information that best reflects the tastes and preferences expressed by the user and, thus, avoid submitting information that would not be of interest to him.

    The collection of Personal Data for this purpose is optional. Any refusal by the User prevents him from staying updated on the services and events that are organized and promoted by AUDAS.

    This processing is based on the free, specific, informed and unequivocal consent of the User, expressed by means of a non-preselected flag on the Site.

    The User has the possibility to revoke the consent at any time, following the indications referred to in point 7 lett. a) of this Notice. In any case, the revocation does not affect the lawfulness of the processing that was carried out before the revocation itself and which therefore must continue to be considered legitimate.

  • Perform statistical analysis and market research, to improve the AUDAS service offer and the use of the Site.

    This Processing of Users 'Personal Data (including those released while browsing the Site) is based on AUDAS' legitimate interest in improving the offer of its services and the functioning of the Site, in order to offer Users a improved service based on their experiences.

    AUDAS has made a balance between this legitimate interest and the Users' right to the confidentiality of Personal Data, and concluded that the former prevailed over the latter also on the basis that it is, precisely, through the implementation of specific offers and services that Users will have the opportunity to take advantage of a higher quality service, as well as more similar to the preferences expressed.

    In any case, where possible, to achieve this purpose AUDAS will use anonymous or aggregate Personal Data that do not identify and do not make Users identifiable.

    Should the Personal Data not be used anonymously, the User will have the right to object to this Treatment at any time, following the indications referred to in point 7 lett. f) of this Information.

  • Allow Users to receive commercial and information communications from partner companies (AUDAS Partner Companies), also carried out through Profiling.

    The collection of Personal Data for this purpose is optional, however any refusal prevents the User from receiving information and commercial communications from AUDAS partner companies.

    AUDAS informs Users that AUDAS Partner Companies are required to process the Personal Data of Users with the same methods and security measures guaranteed by AUDAS. Furthermore, the Processing can be carried out by the AUDAS Partner Companies also through Profiling aimed at personalizing as much as possible the content of commercial and information communications to the characteristics and preferences that the User expressed during registration or browsing the Site.

    The processing in question is based on the free, specific, informed and unequivocal consent of the User, expressed by means of a declaration or positive action (eg flag) on ​​the Site.

    The withdrawal of consent to the processing in question can be exercised at any time, following the indications referred to in point 7 lett. a) of this Notice. Please note that the revocation does not affect the lawfulness of the processing carried out before the revocation itself.

  • Possible establishment of an employment relationship.

  • Carrying out the research and selection of personnel for the purpose of establishing an employment relationship, even for any positions other than those for which the Users have spontaneously applied.

4. Methods of collection and types of Personal Data collected

  • Methods of collecting Personal Data.

    AUDAS collects Personal Data in the following ways:

    directly by Users, by filling in the Contact Us section on the Site;

    automatically on the Site also through Cookies (AUDAS recommends reading the Cookies information available in the dedicated section.

  • b) Types of Personal Data collected. AUDAS collects the following types of Personal Data: Common Personal Data such as, for example, contact details (name, telephone number and email address).

5.Any categories of recipients of the Personal Data

Personal Data are processed personally by AUDAS or, in the event that this is necessary or appropriate for the achievement of the purposes (indicated in point 3 of this Notice) for which they were collected, by third parties who have been selected for reliability and jurisdiction within the European Union. In particular, AUDAS informs Users that Personal Data may be processed by, and / or communicated to:

  • AUDAS employees and collaborators. AUDAS employees and / or collaborators in charge of following up on requests for contact, or information, received by AUDAS through the Contact Us section;

  • IT service providers. Third party service providers necessary to ensure the functioning of the Site (by way of example: company that deals with hosting services);

  • Third party consultants, technical and commercial third parties. Third parties providing consultancy and assistance services (eg tax consultant).

6. Retention period of Personal Data and criteria for its determination

Personal Data are kept by AUDAS for the period of time strictly necessary to achieve the purposes (indicated in point 3 of this Notice) for which they were collected. In particular, without prejudice to the exercise of the right of withdrawal of consent by the User referred to in the following point 7 lett. a), AUDAS retains the User's Personal Data for the following periods:

  • Cookies: for the purposes referred to in point 3 lett. a), it is recommended to read the information relating to Cookies available in the dedicated section;

  • AUDAS employees and collaborators. AUDAS employees and / or collaborators in charge of following up on requests for contact, or information, received by AUDAS through the Contact Us section;

  • Data for commercial purposes. AUDAS retains the Personal Data collected to send the Newsletters (purposes referred to in letter c) of point 3 of this Notice) for a period of 12 months starting from the last interaction of any kind of the User with AUDAS (for example, but not only, the opening of the Newsletter). About the expiry of the time period indicated above, AUDAS will send the User an e-mail communication to allow him to continue receiving the Newsletters. In the event of User inactivity, once the aforementioned period of time has elapsed, AUDAS will automatically delete the Personal Data it has collected to send the Newsletter to the User or will irreversibly transform them into anonymous form, so that they can no longer be connected to this one.

In any case, AUDAS is authorized to keep, in whole or in part, the Personal Data of Users for a maximum period of 10 years from collection, limited to the information necessary to fulfill legal obligations, or even allow it to act or resist in court for ascertaining, exercising and defending one's own right.

7 Profiling

AUDAS informs Users that the Profiling of Personal Data carried out for the sending of Newsletters has the following characteristics:

  • a) Context and object of the Profiling: Profiling relates to the common Personal Data released by the User in the context of browsing the Site and, in particular, is carried out in relation to the preferences expressed by the User with respect to the services and proposals offered. by AUDAS.

  • b) Purpose: Profiling has the purpose of improving the service provided to Users and, at the same time, of providing Users with a personalized service by sending invitations and / or notifications of services which, based on the preferences expressed by the User, may be of particular interest to you.

  • c) Legal basis: Profiling takes place exclusively on the basis of the consent given by the Users in an unequivocal and express way, by means of a positive action (eg flag) on a non-preselected box on the Site. Users to withdraw their consent to the Newsletter at any time, following the instructions provided pursuant to point 9 lett. a) of this Notice.

  • d) Effects for Users: as a result of Profiling, Users have the possibility to receive weekly informative and commercial communications more similar to their interests, without, in any case, any preclusive effect with respect to commercial offers.

AUDAS also reports that:

  • the Personal Data used in the Profiling are adequate and strictly limited to the purposes referred to in point 3 of this Notice;

  • Profiling does not determine any exclusion and / or discrimination for Users.

The Personal Data used in the Profiling are not able to reveal or presume any aspect of 'vulnerability' in the Users, and in no case concern Personal Data belonging to the categories referred to in Articles. 9 and 10 of the Regulation.

8. Transfer of Personal Data to organizations in non-EU countries

The Personal Data of Users are transmitted, pursuant to art. 45 of the Regulation, to organizations residing in non-EU countries only if necessary to achieve the purposes referred to in point 3 of this Notice (for example, but not limited to, to take advantage of a software owned by third parties that allows Newsletter large number of recipients). In particular, in such cases AUDAS transfers the Personal Data of Users only and exclusively to organizations that belong to the so-called Privacy Shield List, that is to the list that indicates the US organizations that guarantee adequate and compliant levels of protection of Personal Data with respect to European principles in Treatment theme. The Privacy Shield List is published and constantly updated by the US Department of Commerce on the basis of the adequacy decision of the European Commission n. 2016/1250, adopted by virtue of art. 25 of Directive 95/46 / EC, which will remain in force until revocation, modification or repeal pursuant to art. 45 of the Regulation.

The US organizations that AUDAS has selected for the possible transfer of Users' Personal Data are the following: Google LLC, including You Tube; FaceBook Inc .; MailChimp.

AUDAS points out that the Personal Data transferred are used and stored by the non-EU organization only for the purposes and time necessary referred to in this Notice.

9. User rights

Pursuant to and for the purposes of the Regulation, for the period referred to in point 6 of this Notice, each User has the right to:

  • Withdrawal of consent to treatment. Revoke the consent at any time without prejudice to the lawfulness of the processing carried out before the revocation. The withdrawal of consent can be exercised through the opt-out at the bottom of the AUDAS communications, or by registered letter with return receipt to the address of the registered office indicated in point 2 of this Notice, or via email.
  • Access to Personal Data. Ask AUDAS to access their Personal Data and information relating to the related Processing, obtaining a copy in electronic format, unless otherwise specifically requested by the User (see Article 15 of the Regulations);
  • Rectification or integration of Personal Data. Ask AUDAS to correct and / or integrate Personal Data, without undue delay (see Article 16 of the Regulation);
  • Cancellation of Personal Data. For specific reasons (for example, unlawful processing, withdrawal of consent, non-existence of the purpose of the processing), ask AUDAS to delete the Personal Data, without undue delay (see Article 17 of the Regulation);
  • Limitation of processing. In the event of specific hypotheses (for example, inaccuracy of Personal Data, illegality of processing, exercise of a right in court), request the limitation of processing (Article 18 of the Regulation);
  • Portability of Personal Data. In case of automated processing, receive the Personal Data in a readable format, for the purpose of communicating it to a third party, or, where technically feasible, request the transmission of Personal Data by AUDAS directly to this third party (so-called right to portability of Personal Data - see art.20 of the Regulation); Opposition to the processing. Oppose the processing of your Personal Data carried out by AUDAS on the basis of your legitimate interest (see Article 21 of the Regulation);
  • Opposition to the processing. Oppose the processing of your Personal Data carried out by AUDAS on the basis of your legitimate interest (see Article 21 of the Regulation);
  • Information in the event of a data breach. Be informed by AUDAS without undue delay of any violations or unauthorized access by third parties to their systems containing Personal
  • Data (so-called data breach - see Article 34 of the Regulation); Complaint to the competent authorities. Make a complaint to the supervisory authority of the EU country in which you reside, work or in which you believe the violation of your rights has occurred (see Article 77 of the Regulation);
